The following applies to every proposal, invoice, and build unless we have signed a
separate written agreement that says otherwise. Placing an order, paying a deposit,
or asking us to begin work means these terms are accepted.
1. Quotations and scope
Prices shown on this page are starting points for the scope described, not fixed
quotations. The scope of any project is limited to what is written in the accepted
proposal or invoice. Anything not written there — extra pages, extra languages,
additional integrations, redesigns after approval, content creation, photography,
copywriting, advertising, or ongoing marketing — is out of scope and quoted
separately. Quotations are valid for 14 days from issue.
2. Payment
Unless agreed otherwise in writing, 50% of the project value is payable in advance
before work begins and the balance is payable before the site is published or files
are handed over. Advance payments are non-refundable once work has started, as they
cover time already committed. Invoices are due on presentation. We may suspend work,
withhold delivery, or take a site offline where an invoice remains unpaid for 14 days
or more. All prices are exclusive of VAT and of any third-party fees, which are
charged at cost.
3. Timelines
Build times quoted on this page are working estimates for a standard project of that
type. The clock starts only once the advance payment has cleared and all content,
logos, access credentials, and approvals we have asked for have been received in
usable form. Delays in feedback, content, third-party approvals, payment gateway or
merchant account activation, domain transfers, or hosting access extend the timeline
by at least the length of the delay. Estimated dates are not guaranteed delivery
dates and no penalty, discount, or compensation arises from a timeline moving.
4. Client material and responsibilities
You are responsible for the accuracy, legality, and ownership of all text, images,
logos, video, product data, and other material you supply, and you confirm you hold
the rights and licences needed to use it. We are not liable for any claim arising
from material you supply, and you agree to indemnify us against such claims. Where we
source stock assets on your behalf, the licence covers the delivered project only.
5. Revisions and approval
Each project includes up to two rounds of revisions at the design stage and one round
after development, within the agreed scope. Further rounds, or changes requested
after a stage has been signed off, are billed at our prevailing hourly rate. If we do
not receive feedback within seven days of sending work for review, the stage is
treated as approved and the project moves on.
6. Hosting, domains, and email
Where a domain and hosting are stated as included, this covers twelve months of
shared cloud hosting on infrastructure of our choosing, and the first year of
registration for one standard domain, subject to availability at the time of
registration. Premium domains, alternative extensions, additional domains, privacy
services, and transfers in or out are chargeable at cost. The domain is registered
for your use as part of the project; where it is held in our account, it will be
released or transferred to you on written request once all invoices are settled.
Business email accounts are provisioned in the quantity stated in your package;
mailbox storage, migration of existing mail, and additional accounts are chargeable.
After the first twelve months, hosting, domain, email, SSL, and licence renewals are
invoiced annually in advance at our prevailing rates. Services may be suspended and
domains may lapse if a renewal is not paid before its due date, and we are not
responsible for loss of data, mail, search visibility, or the domain itself in that
event. Projects hosted on infrastructure you control are excluded from this clause.
7. Third-party services
Projects may depend on services we do not own or control — payment gateways, banks,
shipping and tax providers, CRMs, plugins, themes, APIs, analytics, and mail
services. Their fees, approval decisions, downtime, pricing changes, deprecations,
and terms of use are outside our control and are your responsibility. If a provider
changes or withdraws a service after handover, the work needed to adapt is a new
chargeable job.
8. Support and maintenance
The support period stated in your package begins on the date the site goes live. It
covers correction of defects in the work we delivered and reasonable minor assistance
during normal business hours, Monday to Friday. It does not cover new features,
design changes, new pages, content updates, SEO or marketing work, recovery from
edits made by you or a third party, changes forced by third-party updates, or issues
caused by hosting you control. Support is not a guarantee of continuous availability
and no service level or uptime commitment applies unless separately contracted.
9. Intellectual property
Ownership of the delivered design and site content transfers to you only once all
invoices have been paid in full. We retain ownership of our underlying frameworks,
code libraries, components, and working files, and may reuse them on other projects.
Third-party themes, plugins, fonts, and stock assets remain licensed on their own
terms. Unless you ask us in writing not to, we may display the project in our
portfolio, case studies, and marketing.
10. Data, backups, and security
We take reasonable care with credentials and data supplied to us. Once the project is
handed over, responsibility for backups, updates, passwords, user access, and
security rests with you unless you hold an active maintenance agreement with us. We
are not liable for data loss, hacking, malware, or downtime on infrastructure or
accounts we do not administer.
11. Results
We build to current best practice, but we do not guarantee search rankings, traffic
volumes, conversion rates, sales, or any commercial outcome. Search engines, ad
platforms, and marketplaces change their systems without notice and independently of
our work.
12. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or in
connection with a project is limited to the total fees actually paid to us for that
project. We are not liable for indirect, incidental, or consequential loss, including
loss of profit, revenue, business, goodwill, or data, however caused.
13. Cancellation
You may cancel a project in writing at any time. Amounts already paid are
non-refundable and any work completed beyond the amount paid is invoiced at the point
of cancellation. If a project is put on hold by you for more than 30 days, we may
treat it as cancelled or charge a re-mobilisation fee to restart it.
14. Force majeure
Neither party is liable for delay or failure to perform caused by events beyond
reasonable control, including outages, provider failures, cyber attacks, government
action, or natural events.
15. Governing law
These terms are governed by the laws of the United Arab Emirates, and the courts of
Dubai have exclusive jurisdiction. We may update these terms at any time; the version
published here at the date of your invoice applies to that project.
